You'd think since it was no secret that it was coming they'd have taken care of this months ago.

I think they're waiting to align their new content deals.

If I remember correctly, the first entire batch available for pre-order had sold out, so delaying for content deals, or even conversion of existing content to HD doesn't seem like it should delay the sold-out preorders. Some regulatory approval sounds likely, that or some UI patent licensing was being double cross checked and negotiations are being finalized but are delayed.

Boy, with only a month till production ship, you'd think they'd have already got FCC figured out. There's really not a lot they could do at this point and still expect to ship in a month, at most they could add a ferrite ring to the cable or tweak the software. Normally FCC fixes are identified and fixed well prior to a month before ship, as they often require PCB modifications or component changes.

The most likely explanation is that the person in charge of the product rollout forgot (or didn't know) that people producing the product are out for several weeks in February for Chinese New Year which held up shipments.

I don't think they would need FCC approval if it is just a software update. As far as I can tell the hardware is all the same, Apple TV Take 2 is only a firmware update (granted a great update). I have heard that it has had something to do with a Flickr bug but who knows. I think we should all just be patient and wait, it will come!
