IBM IS GUILTY OF AGE DISCRIMINATION
IBM dodged a bullet when a federal jury on Nov. 6 refused to award punitive damages to a former systems engineer who charged that the company had forced him to take early retirement in 1987. But two days earlier, the same jury in U. S. District Court in Trenton, N. J., found IBM guilty of age discrimination and awarded the engineer, Richard Rathemacher, $315,000 in back pay.
Rathemacher claimed that he signed up for an early-retirement plan only after IBM stripped him of his title and duties. IBM insists it treated Rathemacher "fairly" and is mulling whether to appeal the discrimination verdict.EDITED BY HARRIS COLLINGWOOD
