Under terms of settlement agreement, DFS is expected to receive up to $2.75 billion in the settlement of its lawsuit against V and MA.

CNOOC Ltd. (CEO) says its third quarter total revenues rose 69.1% from a year earlier to $4.5 billion. Notes total third quarter net daily production grew to 549,589 barrels of oil equivalent (BOE), up 15.2% from a year earlier. CEO further stated that its realized crude price increased by 58.7% in third quarter '08, to $106.94 per barrel. Its realized gas price was $3.83 per thousand cubic feet, a year-over-year increase of 11.7%.

Apria Healthcare Group (AHG) shares rise after the company says it notified NYSE that proposed merger of Sky Merger Sub Corp., a wholly-owned unit of an affiliate of Blackstone Group, with and into AHG pursuant to terms of merger agreement dated as of June 18, 2008, is scheduled to close later today, subject to consummation of Sky Merger Sub Corp.'s financing. At effective time of merger each AHG outstanding common share will be converted into right to receive $21.00 in cash, without interest, less applicable withholding taxes.

Fidelity National Information Services (FIS) posts $0.42, vs. $0.31, third quarter EPS from continuing operations on 9.4% organic revenue growth. The EBITDA margin improved to 25.6% compared to 25.1% in the prior-year quarter and increased sequentially from 23.1% in the second quarter 2008.

Hanger Orthopedic Group (HGR) posts $0.23, vs. $0.18, third quarter EPS on 10% higher total sales, 7.3% higher same-center sales. Expects '08 pro-forma EPS to be at high end of previous guidance of $0.80-$0.82.

Americredit (ACF) posts $0.01 first quarter loss per share, vs. $0.49 EPS a year ago, on 15% revenue decline.

Harmonic (HLIT) announces preliminary $0.17, vs. $0.15, non-GAAP third quarter EPS on 11% higher sales. Non-GAAP results excl. investment impairment related to Lehman Brothers and certain non-cash accounting charges. Sees $92-$95 million fourth quarter sales, non-GAAP gross margin of 49%-51%.

Smith International (SII) posts $1.00, vs. $0.83, third quarter GAAP EPS on 27% higher revenue. Excluding non-recurring items, non-GAAP EPS totaled $1.01. The Street consensus estimate had called for non-GAAP EPS of $0.97.

Bemis (BMS) posts $0.44, vs. $0.40, third quarter EPS on 8.7% revenue rise. Expects fourth quarter EPS of $0.40-$0.44, reflecting ongoing benefits of successful cost mgmt and productivity improvement programs. Continues to forecast 2008 capex to be in the $125 million range.

McGraw-Hill Companies (MHP) posts $1.23, vs. $1.34, third quarter EPS on 6.4% lower revenue. Current quarter includes a pre-tax restructuring charge of $0.05 for severance costs related to a workforce reduction. Says in the face of challenging conditions in financial markets and the economy, MHP now forecasts $2.63-$2.65 2008 EPS (excl. restructure charges), which assumes EPS of $0.40-$0.42 fourth quarter EPS. Check Point Software Technologies Ltd. (CHKP) posts $0.44, vs. $0.41, third quarter non-GAAP EPS on 8.5% higher revenue.
