Md. judiciary eyes expanded power in foreclosures

A Maryland judicial committee has drafted an emergency proposal that would allow a judge to dismiss foreclosure cases, if an affidavit filed in the case is found to be invalid.

The Maryland Standing Committee on Rules of Practice and Procedure worked out amendments to the proposal at a meeting in Annapolis on Friday.

Maryland's highest court will consider the proposal on Tuesday.

Alan Wilner, who chairs the panel, wrote in a letter to committee members on Thursday that preliminary audits have found that hundreds of bogus affidavits have been filed in Maryland courts.
